The opinion of the court was delivered by Defendant State Farm Mutual Insurance Company appeals from a
judgment of the trial court awarding plaintiff Leslie O. Dreiling
personal injury protection (PIP) benefits under the Kansas
automobile injury reparations act (K.S.A. 1979 Supp. 40-3101 et
seq.). The sole issue on appeal is whether the trial court erred in
awarding PIP benefits to plaintiff, who was injured while
operating a borrowed automobile, but who, at the time of the
accident, owned a registered, uninsured and inoperable
automobile.
